Terms and Conditions of Service for Western Pest Control Services

These Terms and Conditions ("Agreement") are entered into by and between the customer ("Customer," "you," or "your") and Western Pest Control, a Utah-based pest control company ("Company," "we," "our," or "us"). By requesting, using, or accepting our pest control services, you agree to abide by these Terms and Conditions. Please read them carefully.
1. Services Provided
Western Pest Control offers pest control and management services to residential and commercial properties in Utah. Services include, but are not limited to:
- Inspection and assessment of pest infestations.
- Application of pest control treatments.
- Ongoing monitoring and follow-up visits.
- Recommendations for pest prevention and maintenance.
The specific services to be provided, including the type of pests addressed, will be outlined in the Service Agreement or Proposal you receive from Western Pest Control.
2. Service Agreement
By requesting and receiving pest control services from Western Pest Control, you acknowledge and agree to the following:
- Scope of Work: The services provided will be clearly outlined in the Service Agreement. Any changes to the scope of work must be agreed upon in writing.
- Service Frequency: Some services may require ongoing or periodic visits, which will be outlined in your Service Agreement. You may cancel or reschedule appointments by providing at least 24 hours' notice.
3. Customer Responsibilities
The Customer agrees to:
- Provide Access: Ensure our technicians have safe and unobstructed access to all areas of your property necessary to perform pest control services. This includes indoor and outdoor spaces, attics, crawl spaces, and other areas where pests may be present.
- Prepare Property: Follow any instructions provided by Western Pest Control prior to service (e.g., moving furniture, securing food, and removing pets).
- Follow-Up: In the event that a pest issue persists after treatment, you agree to notify Western Pest Control for follow-up inspection or additional services.
4. Payment Terms
- Pricing: All prices for pest control services are outlined in your Service Agreement or Proposal. Prices are subject to change based on the nature and scope of services requested.
- Invoices and Payment: Payments for services are due upon receipt of service, unless otherwise agreed in writing. Payments may be made via credit card or ACH, unless other payments are agreed upon by Western Pest Control. Late Fees: A late fee of 5% per month may be charged for any unpaid invoices after 30 days from the invoice date.
5. Warranties and Guarantees
- Pest Control Effectiveness: While we will use commercially available and effective methods to treat your property, we cannot guarantee 100% elimination of pests due to various uncontrollable factors, such as environmental conditions, the severity of infestations, and ongoing exposure to pests.
- Follow-up Services: If pests reappear within a specified period after treatment, follow-up services may be offered. The duration and terms of any follow-up guarantees will be outlined in your Service Agreement.
6. Health and Safety
- Product Safety: All pest control products used by Western Pest Control comply with applicable health and safety regulations. If requested, we will provide you with
information on the specific products used during service. - Customer Concerns: If you have health concerns regarding the products or treatment methods, you agree to notify Western Pest Control before the service is performed. We will take necessary precautions or discuss alternative treatments if needed.
- Pesticide Regulations: Western Pest Control complies with all relevant state and federal pesticide regulations, including those set forth by the Utah Department of Agriculture and Food (UDAF).
7. Liability
- Limitations: Western Pest Control will take reasonable precautions to avoid damage to your property while performing pest control services. However, we are not liable for any incidental, consequential, or indirect damages caused by the service, except in cases where such damage is directly caused by our negligence or willful misconduct.
- Indemnity: You agree to indemnify and hold Western Pest Control harmless from any claims, losses, damages, or expenses arising from third-party claims or improper handling or misuse of pest control products after our services are completed.
- Gross Negligence or Willful Misconduct: Western Pest Control is not exempt from liability for damages caused by its own gross negligence or willful misconduct. Any damages resulting from such actions will be our responsibility.
8. Postponing, Cancellation, or Termination
- Cancellation: If the agreement is terminated prematurely for any reason, and the initial service has been provided, you agree to reimburse any discount applied at the initial service.
- Termination by Western Pest Control: We reserve the right to terminate services at any time if the customer fails to comply with these Terms and Conditions, engages in behavior that jeopardizes the safety of our technicians, or fails to make timely payments.
9. Confidentiality and Privacy
Western Pest Control respects your privacy. Any personal or property information shared by you will be kept confidential and will only be used for the purpose of delivering services. We will not disclose your information to third parties except as required by law.
10. Dispute Resolution
- Negotiation: In the event of any dispute, both parties agree to attempt to resolve the matter through informal negotiation.
- Arbitration: If the dispute cannot be resolved through negotiation, either party may request mediation or arbitration in accordance with the laws of the State of
Utah. Arbitration will take place in [Insert County], Utah, and will be conducted by an independent arbitrator chosen by both parties. - Small Claims Court: Nothing in this Agreement prevents you from pursuing claims in small claims court.
11. Force Majeure
Neither party shall be held liable for any delay or failure to perform their obligations under this Agreement due to causes beyond their reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or other unforeseeable events.
12. Modifications to Terms
Western Pest Control reserves the right to amend or modify these Terms and Conditions at any time. Any changes will be communicated to you in writing, and your continued use of our services will constitute acceptance of the updated Terms and Conditions.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles.
14. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remainder of the provisions will remain in full force and effect.
By requesting or receiving pest control services from Western Pest Control, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
